"abstractNote": "challenges the view that privacy interests are protected primarily by law. Instead, I argue that much of society's privacy is protected implicitly by transaction costs. This renders a significant portion of societal privacy vulnerable when transaction-cost-reducing technologies become widely used.I first observe that society explicitly uses and implicitly relies upon transaction costs to regulate behavior in different substantive areas. I then explore how this transaction-cost-based regulation operates in the privacy realm. Based upon the understanding that society relies upon non-legal devices such as markets, norms, and structure to regulate human behavior, this Essay calls attention to a class of regulatory devices known as latent structural constraints and provides a positive account of their role in regulating privacy. Structural constraints are physical or technological barriers which regulate conduct; they can be either explicit or latent. An example of an explicit structural constraint is a fence which is designed to prevent entry onto real property, thereby effectively enforcing property rights. By contrast, latent structural constraints, are the secondary costs arising from the technological state of the world - transaction costs - which implicitly regulate conduct by making certain activities too difficult to engage in on a widespread basis.Society relies upon these latent structural constraints - or transaction costs - to reliably inhibit certain unwanted conduct in a way that is functionally comparable to its use of law. For example, society has frequently depended upon the search costs involved in aggregating and analyzing large amounts of information to effectively protect anonymity. We might think of some of these inhibited behaviors -- behaviors constrained by transaction costs -- as constituting implicit \"structural rights.\" The regulatory aspect of latent structural constraints and transaction costs may be non-obvious to policymakers in most instances. This is because it is common to think of transaction costs as manifestations of inefficiency rather than as serving a functional role. A focus on structural rights -- rights protected solely by the presence of transaction costs -- becomes significant because such rights are vulnerable to sudden dissipation. Emerging technologies tend to lower transaction costs in the areas where they are employed. This lowering of transaction costs may have the unintended side effect of eliminating structural rights that were regulated by the presence of transaction costs. For example, the emergence of search and data aggregation technologies may have had the unintended side effect of permitting privacy intrusions that were previously impossible due to the regulatory role of previously existing transaction costs.This Essay describes a conceptual framework by which policymakers can explore this association between constrained behavior and latent structural constraints and suggests that they employ this conceptualization in order to identify non-obvious privacy interests which may be threatened by emerging technologies.",

"abstractNote": "established law, information in court records is open to the public, but it may be sealed upon a fact-based showing either that the information is not a matter of legitimate public concern or is sufficiently sensitive to need such protection. Under the former paper-based court record system, however, routine violations of these publcity standards were widely tolerated. At the same time, the practical obscurity of paper provided a default privacy benefit for negligently unsealed sensitive information. With the introduction of electonic filing, old improper sealing practices are now increasingly being exposed and criticised; while the dealth of practical obscurity has caused individuals with sensitive information in court files, to be increasingly exposed to harm. This article argues that restoring an appropriate homeostasis to the judicial information eco-system, where legitimate privacy and publicity interests are both protected, does not require replacing established common law standards; but it will require the adoption of new legal procedures, better use of information technologies, and more careful training of judges and lawyers. Ultimately, to properly achieve this goal, the existing common law adversarial system of information mangement will need to be supplemented by a new administrative model.",

"abstractNote": "troversies about the National Security Agency's warrantless wiretapping of international calls have overshadowed equally disturbing allegations that the government has acquired access to a huge database of domestic call traffic data, revealing information about times, dates, and numbers called. Although communication content traditionally has been the primary focus of concern about overreaching government surveillance, law enforcement officials are increasingly interested in using sophisticated computer analysis of noncontent traffic data to map networks of associations. Despite the rising importance of digitally mediated association, current Fourth Amendment and statutory schemes provide only weak checks on government. The potential to chill association through overreaching relational surveillance is great. This Article argues that the First Amendment's freedom of association guarantees can and do provide a proper framework for regulating relational surveillance and suggests how these guarantees might apply to particular forms of analysis of traffic data.",

"abstractNote": "Current applications of electronic performance monitoring based on job design theories that consider worker performance rather than stress issues are likely to generate unsatisfying and stressful jobs (Smith et al, 1986). This study examines critical job design elements that could influence worker stress responses in an electronic monitoring context. A questionnaire survey of employees in telecommunications companies representative of each region in the United States examined job stress in directory assistance, service representative and clerical jobs with specific emphasis on the influence of electronic monitoring of job performance, satisfaction and employee health. Useable surveys were received from 745 employees representing seven operating companies and AT & T; a response rate of about 25%. The results of this survey indicated that employees who had their performance electronically monitored perceived their working conditions as more stressful, and reported higher levels of job boredom, psychological tension, anxiety, depression, anger, health complaints and fatigue. It is postulated that these effects may be related to changes in job design due to electronic performance monitoring.",

"abstractNote": "Computer-based performance monitoring (CPM) provides managers with the ability to continuously, and unobtrusively, monitor the work performed by their employees. This paper examines the impact that CPM has on productivity when people are monitored on only a portion of the work that they perform. In a simulated work setting, subjects worked on two computerized tasks, and were led to believe that their work on one, both, or none of the tasks would be electronically monitored. People who were monitored only on a relatively simple task tended to work at a faster rate on both their monitored and non-monitored tasks, in comparison to people who were not monitored at all. People who were monitored only on a task that was more moderate in level of difficulty did not work any faster or more accurately than people who were not monitored. The results of the current study suggests that under certain conditions, employees may not discriminate between monitored and non-monitored work. Recommendations are offered to managers who are considering implementing CPM in their workplace.",
