            "abstractNote": "This article investigates whether Canada has changed in ways the ways that proponents of the Charter desired and anticipated. We examine the progress of groups that the Charter was intended to benefit (Aboriginal peoples, women, visible minorities, and immigrants); areas of state action that the Charter was intended to regulate (the criminal process and bureaucratic behaviour); and aspects of our communal and public life that the Charter was intended to animate and enhance (politics and inter-group cultural relations). We rely on a significant number of studies of Canadian social development during the period from 1982 to the present. Available evidence suggests that progress towards the vision of Canada inscribed in the Charter has generally been modest, halting, non-existent, and, in some cases, negative. What we claim is that the Charter does not much matter in the precise sense that it has not--for whatever reason--significantly altered the reality of life in Canada. Cet article examine si le Canada a change par rapport a ce que les auteurs de la Charte voulaient et prevoyaient. Nous etudions le progres des groupes que la Charte devait avantager (Autochtones, femmes, minorites visibles et immigrants), les zones d'action de l'Etat que la Charte devait regir (regime penal et comportement bureaucratique), ainsi que des aspects de notre vie commune et publique que la Charte devait animer et ameliorer (politique et relations culturelles intergroupes). Nous nous fions a un nombre important d'etudes sur le developpement social canadien pendant la periode allant de 1982 a aujourd'hui. Les elements de preuve disponibles font penser que le progres vers la vision du Canada qui est inscrite dans la Charte a generalement ete modeste, hesitant, non existant et, dans certains cas, negatif. Nous pretendons que la Charte ne compte pas vraiment dans le sens oU elle n'a pas considerablement modifie la realite de la vie au Canada.",

            "abstractNote": "Abstract: This paper examines the failure and success of aboriginal self‐government during the 1982–87 period by focusing on the constitutional talks, their impact on the federal and provincial governments, and the resultant activity of those governments. The paper begins with a brief account of the emergence of aboriginal self‐government onto the constitutional table. The paper then analyses the consequences of the emphasis on constitutional change and the use of the first ministers' constitutional conferences for the development of aboriginal self‐government. The paper reveals that this emphasis was bound to result in frustration and complication of the pursuit of aboriginal self‐government in the constitutional arena. However, the paper concludes that the constitutional process wrought unintentional results that benefited aboriginal communities in Canada. The conferences served as a powerful inducement to the development of the issue in policy areas. Sommaire: Cette étude examine les échecs et les succès dans la recherche d'uii gouverne‐ment autonome pour les peuples autochtones durant la période 1982–1987, en analysant principalement les débats constitutionnels, leurs répercussions sur les gouveniements fédéral et provinciaux et les activités qui en ont résulté parmi ces gouvernements. L'étude mon‐tre dabord brièvement comment la question de I'autodéterminatioii des peuples autochtones est arrivée à la table des débats constitutionnels, pour ensuite analyser comment I'importance accordée aux changements constitutionnels et aux Conférences con‐stitutionnelles des premiers ministres a influé sur I'autodétermination des autochtones. L'autenr révèle qu'en attachant tant d'importance aux changements constitiitioiinels, I'on ne pouvait clue créer des frustrations et des complications dans la recherche d'un gouverne‐ment autochtone. Toutefois, elle conclut que le processus constitutionnel a eu indirecte‐ment des résultats bénéfiques pour les communautés autochtones au Canada puisqiie les conférences ont puissamment favorisé le progrès de la question dais le domaine des politiques.",

            "abstractNote": "Abstract Recent decades have seen the rising of a vital, multifaceted politics in Canada, focused on the future relations between Aboriginal peoples and the Canadian state. While there are many debates about specific arrangements, there is consensus that the negotiated establishment of Aboriginal self-government constitutes a major piece of unfinished business for the Canadian federation. This essay seeks to contribute more structure and focus to contemporary debates by examining four different models of Aboriginal government: “mini-municipalities,” a third order of government institutions, the public government federal option, and nation-to-nation relations. Each form has different implications for the relationship between Aboriginal and Canadian political communities, and each has different implications for the institutions and practices of Canadian federalism. We argue that further concurrency of powers and greater asymmetries in intergovernmental relations are likely to be notable features of the Canadian federation, and that no single model or pathway is likely to emerge as the dominant one in the near and medium term.",

            "abstractNote": "Despite a rich and diverse literature on the revitalization of Indigenous legal traditions and constitutional orders, no one has yet looked at modern Aboriginal constitutions in Canada. This essay draws upon the comparative constitutional design and Aboriginal politics literatures to describe and analyze the texts of 14 Aboriginal constitutions. The findings suggest that these constitutional documents are similar to non-Aboriginal ones in many ways. Specifically, both deal with similar political problems and try to express and protect local political cultures. In short, they represent practical attempts to marry Aboriginal and non-Aboriginal constitutional orders and legal traditions in the contemporary context. Students of Aboriginal politics and law should pay greater attention to these documents, and especially to their origins and evolution over time.",

            "abstractNote": "While Canada is often called a pluralist state, there are no sustained studies by political scientists in which aboriginal self-government is discussed specifically in terms of the analytical tradition of pluralist thought. Aboriginal self-government is usually discussed as an issue of cultural preservation or national self-determination. Aboriginal identity is framed in terms of cultural and national traits that are unique to an aboriginal community and self-government is taken to represent the aboriginal communal desire to protect and preserve those traits. Is such an understanding of what motivates aboriginal self-government accurate, or does it yield an incomplete understanding of the complex phenomenon that aboriginal self-government in Canada represents? The political tradition of pluralism allows for analysis of aboriginal self-government that addresses questions left unattended by the cultural and nationalist frameworks. Pluralism is often viewed as a public arrangement in which distinct groups are given room to live side by side, characterized by mutual recognition and affirmation. At the same time, there are different faces of pluralist theory and each addresses questions about the recognition and affirmation of aboriginal self-government in different ways. Those three contemporary faces can be distinguished by the labels communitarian, individualist, and relational. The major hypothesis advanced is that aboriginal self-government is better understood if an \"identification\" perspective on aboriginal identity is adopted as opposed to a \"cultural\" or \"national\" one and if that perspective is linked to a relational theory of pluralism as opposed to a communitarian or individualist one. The identification approach examines aboriginal identity not in terms of cultural and political traits, but in terms of identification with, and political commitment to, an aboriginal community. Relational pluralism in turn, examines the challenge of aboriginal self-government in terms of power differences within aboriginal communities and between aboriginal and Canadian governments. Applying these approaches to aboriginal politics in Canada confirms their suitability. Contrary to what previous scholarship has assumed, aboriginal self-government should not be seen primarily as a tool to preserve cultural and national differences as goods in and of themselves. The politics of aboriginal self-government should be seen as involving demands to equalize current imbalances in power so that aboriginal communities and the individuals within them can construct aboriginal identities according to their own design.",
