This paper analyzes the discretionary authority of local school boards in three states, California, Georgia, and Ohio, using Zimmerman’s (1981) fiscal, structural, functional, and personnel home rule framework. This paper finds important differences exist among the three states in the amount of discretionary authority granted to local school districts by the state government, especially in the area of fiscal autonomy. School districts in Georgia and Ohio possess more fiscal autonomy than school districts in California. This paper outlines some important criteria to use when comparing local school district discretionary authority across states. of the doctrine of municipal home rule and its relationship to fiscal decisionmaking within state governments. The basic claim is that state and local governments compete against one another for fiscal control and authority. States naturally have a substantial leg up in this fiscal competition; moreover, state government manages local fiscal authority through an admixture of constraints, incentives, and resources. On the other hand, the developing doctrine of municipal home rule provides an unsteady shield from state control. Of course, the viability of this sheild rests on interpretive judgments of central decisionmakers, often state judges. While this survey offers no comprehensive theory of how to mediate the tension between state and local governments, it highlights the way in which state constitutional law can accomplish the aim of regulating the processes of intrastate fiscal competition. This comparative analysis locates culturally meaningful and theoretically significant distinctions among the regions and provides data for the development of explanatory models in which each region varies along a dimensional continuum. At the macro-level of analysis, the impact of globalization and flexible accumulation with increased local heterogeneity, increases in inequality and changes in perceived crime rate emerge as the major underlying factors in the fear of crime and others found in all three regions.
