In recent years, a federal court has assailed photocopying of book chapters; universities have faced infringement accusations when they make computer software available to students and faculty; and media facilities have struggled with the possible limits on using copyrighted videotapes. This book provides administrators, instructors, lawyers, librarians, and educational leaders with guidance on the principles that should underlie the construction of institutional copyright policy. It offers an explanation of copyright and the ambiguous concept of \"fair use\" as they affect and are affected by higher education. Further, it shows that universities do have choices when developing standards within the fair use law, choices that do not involve unnecessary costs or obstacles, and that some standards are better suited to serving the needs and goals of the academy.             "abstractNote": "This study examines the process of requesting copyright permissions through the Copyright Clearance Center’s (CCC) pay-per-use service for electronic course reserves at the Penn State University Libraries in 2008. The authors investigate the efficiency of this process as a function of the percentage of permission requests successfully mediated by the CCC, the time required to submit and fill requests, and transaction and royalty costs. They conclude that, while the CCC is clearly more efficient than attempting to request permission from individual rightsholders, the process remains burdensome and rightsholder royalty pricing models are unclear.",

            "abstractNote": "This Article celebrates the twenty-one-year majority status of Campbell v. Acuff-Rose Music, Inc. Campbell has unquestionably had transformative impacts on the doctrine of fair use in U.S. copyright case law, making several significant contributions that go well beyond the Court's endorsement of the \"transformative\" nature of a use as tipping in favor of fairness. Several notable cases have built upon the analytical foundation established in Campbell. This Article also considers possible futures of fair use. What will fair use look like twenty-one years from now? Will it stay much as it is right now, or will it change, and if so, how? Some critics think that fair use has gone too far and are urging a return to a more restrictive scope for the doctrine. This Article considers and responds to various critiques of the present state of fair use law, including whether fair use is consistent with international treaty obligations. This Article concludes that fair use will survive these critiques and will continue to evolve to provide a useful mechanism for balancing the interests of authors and other rights holders, on the one hand, and subsequent authors and other users of copyrighted works, on the other hand. It discusses some new horizons that commentators have imagined for fair use to address certain problems that beset copyright law today. Of the possible futures of fair use, that which would preserve the status quo and expand fair use into new horizons is the one most likely to occur and most to be desired.`",

These decisions are based on constitutional principles that protect states from liability in federal court; meanwhile, copyright infringement cases are required to be filed only in federal courts. These developments might lead some members of the academic community to conclude that state institutions are sheltered from any threat of legal liability; therefore, they need not concern themselves with subtleties and responsibilities associated with copyright and fair use. Leading to that conclusion would be a serious error for many reasons. Despite some protection from legal liabilities, that protection is hardly complete and is far from certain.",

She said that the web had changed expectations about how quickly and easily people could access information and knowledge, and proposed strengthening the role of digital repositories, where scientists make the results of their work available for free.</p> <p class=\"articleParagraph enarticleParagraph\">She also welcomed moves by publishing companies to extend licences so that members of the public could access scientific literature at their local libraries.</p> <p class=\"articleParagraph enarticleParagraph\">In recent months, publishers of scientific journals have been criticised by academics for locking the work produced by their peers, and funded largely by taxpayers, behind paywalls and charging UK universities around £200m a year for access.</p> <p class=\"articleParagraph enarticleParagraph\">Supporters of the \"academic spring\" have argued that the results of publicly funded research should be made available to anyone who wants to use it, for whatever purpose. This is a position supported by the UK government, which has drafted in Wikipedia founder Jimmy Wales to help achieve its goals for open access.</p> <p class=\"articleParagraph enarticleParagraph\">Many supporters of open access advocate the \"gold\" model, where researchers pay an upfront fee to a journal for their paper to be made available online, free of charge, as soon as it is published. Finch said that large-scale uptake of such a system would take time and subscription-based journals would remain important during the transition. \"We don't believe it can be cost-free, certainly in the period where we have two systems running in parallel,\" she said.</p> <p class=\"articleParagraph enarticleParagraph\">A combined economic model outlined in the report estimates that it would cost around £38m per year in publishing fees. The figure is dependent on the amount journals charge to publish and takes into account a reduction in journal subscription fees for libraries. In this combined scenario, half of the UK's publicly funded research would be published as gold open access.</p> <p class=\"articleParagraph enarticleParagraph\">Other scenarios in the report that assume a lower average charge by publishers suggest that the higher education sector could actually save up to £5m per year by moving to gold open access.</p> <p class=\"articleParagraph enarticleParagraph\">The additional costs for other access initiatives are also outlined. Extending licences to public libraries would cost approximately £10m and it would cost around £5m to improve the infrastructure around central repositories and another £5m for one-off costs. Meanwhile, he reiterated his support for open access, saying that the UK could take a leadership role around the world.</p> <p class=\"articleParagraph enarticleParagraph\">\"There is a very lively debate about this in the US and I'll be briefing members of the American research community and administration this week on what we're doing on open access. If we can make it a shared European-American initiative, that would bring down the cost and it would be far better if we could all agree a way forward.\"</p> <p class=\"articleParagraph enarticleParagraph\">Professor Adam Tickell of the University of Birmingham, who served on the working group behind Finch's report, said UK universities \"recognise and embrace the strong moral case that the public who fund our research should have unimpeded access to the results of that research\".</p> <p class=\"articleParagraph enarticleParagraph\">He added: \"The sector enthusiastically welcomes the strong commitment to open access from all the stakeholders.
