Between their beginning in 1300 and 1858, by which point the courts had lost much of their jurisdiction, there are surviving papers for over 14,000 cases. These have recently been catalogued in an on-line database . The cases cover a wide range of jurisdiction and provide opportunities for studies in social, economic and administrative history. This article examines four ways the records can be used: medieval defamation; sixteenth-century religious belief; seventeenth- and eighteenth-century education; and nineteenth-century marital discord. Despite the growing impact of the printing press, texts themselves circulated and were received in a context that was pervasively oral. The majority of the population communicated primarily in speech rather than in writing, and even when they accessed written texts, they were most likely to do so through the mediation of speech by listening to others read out loud. Many literary and scholarly genres moreover, from poetry to theater, were conceived for oral diffusion. From the Renaissance interest in the study of classical rhetoric to conversation manuals, from civic decrees punishing blasphemy to the preoccupation with rumors and the collection of word-of-mouth It argues that existing historiographies place insufficient emphasis on the shaping mechanisms of legal and court process in the production of narratives of complaint. For rather than being incidental or ‘background’ information to dispute, the existence of an ‘angry and malicious mind’ was fundamental to the definition of slander under ecclesiastical law. This claim has implications for historians of emotion more generally, as it reveals the complex traditions of emotion beliefs in specific discursive fields in the past, and the (related) difficulties of accessing or interpreting individual ‘feelings’ through the historical record. Yet in proving the existence of ‘anger’ in slander disputes, contemporaries cited as evidence a range of communicative displays – from the volume and pitch of voice used by the defendant to the physical distance between disputants – that have seldom been considered as part of emotional embodiment.
