Panic-stricken British shipowners, merchants and East India Company officials apprehended disruption of their intercontinental trade, so vital to the burgeoning British Empire. In all these cases, they accused Indian seamen (lascars) of selfish ship-burning. As a context, the lascars had, for centuries prior to European arrival in the Indian Ocean, worked collectively under their own petty officers. They and Indian recruiters in each port had long resisted colonial efforts to appropriate their maritime labour system. Newspapers, medical periodicals and the newly formed National Society for the Prevention of Cruelty to Children (NSPCC) regularly claimed that, though almost impossible to prove, cases of lethal child abuse were endemic across the United Kingdom. These anxieties appear to have reached their zenith in the 1880s and 1890s, yet despite the regular (albeit not unchallenged) repetition of this claim in the press and before Parliament, actual cases of child homicide where it was alleged that infant life insurance had been the motivation for the crime seem to have been few and far between. Nor did critics of the practice ever succeed in banning it outright. By 1908 politicians felt able to assert that this idea was utterly without foundation, and the once persistently repeated rhetoric of malevolent working-class parents seems to have disappeared altogether by the First World War. Whilst many met a violent death, others died through willful neglect and malnourishment. Some of these cases (although harder to detect and prosecute) were brought to trial at the Old Bailey. With the rise of forensic medicine, the evidence of medical witnesses was seen as essential in homicide trials. The role of these expert witnesses has been much studied by historians, especially in a number of sensational murder trials. However, less attention has been paid to the health-related knowledge of non-medical witnesses, or to the non-sensational trials of mothers accused of killing their children by starvation. This study focuses on these less-studied areas with the aim of examining what was considered to be health-related knowledge in the courtroom, and who was considered to have authority over that knowledge. Using the trial records of the Old Bailey Proceedings, it looks at the health-related knowledge of all witnesses and how the knowledge of different witness types was presented, used and received within the courtroom.\n All types of witnesses were seen as having valuable health-related knowledge covering a variety of areas. Whilst the knowledge and opinions of doctors were questioned most closely, lay witnesses, particularly female community members, presented a wealth of knowledge about mothering and child health. Over the period of this study, medical understandings of child health and nutrition were changing, infant welfare was becoming a major concern, and medical men and authorities were having increasing involvement in the private, female sphere of the family. These cases reflect many of these changes but also much continuity. The value accorded to medical and lay knowledge about mothering within the courtroom indicates that, in the eyes of many, control of this knowledge outside of the courtroom was the domain of both Although the Jewish population of London (and indeed Britain) was facing increasing anti-immigrant and racist rhetoric during the late nineteenth and early twentieth centuries, the cases discussed here were treated with equivalent leniency to those of other women charged with newborn child murder and concealment of birth in this period. Despite the very different circumstances of each case, the defendants were able to fit the story of their crime into a highly recognizable script that dovetailed neatly with the dominant discourse of ‘the infanticidal’ shared by both popular and elite British society. Contemporary magistrates Henry Fielding and Patrick Colquhoun blamed these Jews for increases in crime. They made no mention of the many Jewish peace officers who patrolled the city. Fielding and Colquhoun situated Jews as part of the crime problem and not the policing solution. Historians have likewise discussed Jewish criminality and ignored the role of Jews in combating crime in the eighteenth century. However, there was an entire group of Jewish men who both enforced the law and used the law to their own advantage - peace officers and thief-takers. In fact, throughout the eighteenth century Jewish men and women were involved in the policing of the city in official, quasi-official, and unofficial capacities. Sometimes it is difficult to clearly delineate when they operated in which role, but what does remain constant is the importance of their participation. The focus of early modern policing was extremely local in nature. While this incurred the criticism of nineteenth-century reformers, it also produced a flexible system which allowed Jewish men to act as constables and watchmen. The heart of the Jewish community was in Duke’s Place, a liberty in Aldgate ward. This enabled the creation of “constables for the Jews”. There were practical reasons for having Jewish constables. They knew the community best and were usually multilingual. Jews were heavily involved in the re-sale trades, making them ideal candidates to police the flow of stolen goods. The contemporary prejudices against Jews ensured that only those who were willing to renounce all aspects of Jewish life were assimilated into English society at any level. There were a select number of occupations which brought Jewish men and women into association with their gentile neighbours. Jewish peddlers, porters, and dealers naturally came in contact with a variety of people. Importantly there was another vocation which similarly allowed Jewish men to participate in the wider London world – policing. Jewish and gentile peace officers co-operated and worked together in companionship not seen in other trades. victims, witnesses and especially as the accused when they came to the Old Bailey in the eighteenth and early nineteenth centuries. It concludes that there was no significant discrimination against black people as prosecutors and witnesses. Moreover, between 1791 and 1805, when a source containing systematic evidence on the ethnicity of the accused is briefly available, black people probably formed a smaller proportion of the accused than they did of the London population as a whole; and those who were prosecuted were less likely than average to be convicted and more likely to have their charges reduced.
