The scenery chosen to dramatize human right's violations during the 1937 genocide on Massacre River is presented in El Masacre se pasa a pie, by Prestol, Massacre River (Le Peuple des Terres Melées), by Philoctète and The Farming of Bones, by Danticat. These novels explore, among other themes, how the pronunciation of a word as ‘perejil' (parsley) is used to distinguish between a Dominican and a Haitian living in the frontier: a racialized discourse easens xenophobia, a fundamental aspect of the ideological discourse established by the urban elites of this historical period. The 1937 massacre destroys a multiethnic world and posits a racial, cultural, linguistic and religious discourse that consolidates a conservative republic under the imperative of homogeneity. Ese efecto no file intenso, más que nada debido a falta de medidas para la puesta en practica del tratado. Pero la Convención ha sido ampliamente ratificada -137 Estados lo hicieron hasta hoy- y ha contribuido a un progreso del Derecho Penal Internacional, traducido en la creación de tribunales especiales, para los crímenes cometidos en la ex gugoslavia y en Ruanda, y en el establecimiento del Tribunal Penal Internacional de La Haya, competente para juzgar actos de genocidio a nivel global. Se alude a la relación entre la Convención de 1948y otros textos antidiscriminatorios, y se analiza el contenido y los alcances del documento, que requiere actualización. La Corte Internacional de Justicia se ha pronunciado en dos ocasiones sobre la Convención, en 1951 sobre la cuestión de las reservas, y en 2007 sobre las obligaciones que crea para los Estados, y no solo para individuos. El autor comenta someramente esta debatida sentencia, cuya importancia mayor reside en la clarificación de la obligación de todos los Estados de prevenir y reprimir el crimen. Entre las principales propuestas está la de ampliar la Convención para incluir el genocidio cultural o por motivaciones políticas o socio-económicas.
