With murders in death penalty states and Supreme Court decisions held constant, tests of hypotheses about lags suggest that public support and Republican strength in the states influence yearly executions by their effects on death sentences rather than the later appeals process. Other dynamic results show that national level Republican strength, presidential elections that emphasize law and order, economic inequality, and higher murder rates increase yearly executions because they affect the extremely influential but later appeals process. Civil rights protests, however, immediately reduce both public support and executions. Although minority threat enhances public support for capital punishment, this contextual factor does not explain executions. These results are unique as no prior studies have assessed the conditions that determine how often the harshest punishment is used. The research found that urbanized states characterized by higher concentrations of Black citizens and liberal populations and political elites are less likely to legislate capital punishment and execute fewer prisoners. States with higher concentrations of Black citizens and conservative populations and political elites, primarily in the South, and states with a high percentage of Hispanic population are more likely to have a high number of prisoners on death row and to execute a higher number of those prisoners. Using multiple data sets representing France, Belgium, the Netherlands, East and West Germany, Italy, Luxembourg, Denmark, Great Britain, Greece, Spain, Finland, Sweden, Austria, Canada, Ireland, and Portugal, we examine whether racial and ethnic intolerance—animus, resentments, or negative sentiments toward minorities—predicts greater support for the death penalty. Our results reveal that the respondents were significantly more likely to express support for capital punishment if they were racially or ethnically intolerant while controlling for other covariates of public opinion. These findings indicate that the link between support for capital punishment and racial and ethnic animus may occur universally in countries with conflicted racial and ethnic relations. To explore such differences, we embedded an experiment in a national survey in which respondents are randomly assigned to one of several argument conditions. We find that African Americans are more responsive to argument frames that are both racial (i.e., the death penalty is unfair because most of the people who are executed are black) and nonracial (i.e., too many innocent people are being executed) than are whites, who are highly resistant to persuasion and, in the case of the racial argument, actually become supportive of the death penalty upon learning that it discriminates against blacks. These interracial differences in response to the framing of arguments against the death penalty can be explained, in part, by the degree to which people attribute the causes of black criminality to either dispositional or systemic forces (i.e., the racial biases of the criminal justice system).
