Farmers have received inadequate supplies of irrigation water and municipalities are forced to continue depleting groundwater. Water reserves in reservoirs are almost non-existent. Science informs us that this situation is, on average, only going to get worse as the climate warms and also probably dries. Population growth will exacerbate these problems. Continuation of current policy will inevitably result in a lifeless Rio Grande that serves only as an occasional water conduit, conversion of most farmland into low-density housing, and very large, very dry cities. Water in New Mexico is administered under a largely fictional legal system. The legal instrument for implementing prior appropriation is priority administration, but in the middle and lower Rio Grande, at least, it is never used. The doctrine appears both unjust and unworkable to the modern population of New Mexico. Unlike most western states, New Mexico does not recognize instream flow as a beneficial use, but in reality is forced to implement it, not under state law but rather under the Endangered Species Act. New Mexico can either continue to blunder forward into a rapidly changing future while wearing the “emperor’s clothes” of a 19th century water code, or it can establish an adaptable new system through revision of the laws. Water is valued for life sustaining and practical aspects such as drinking, bathing, and cooking. Water is also one of the most important and most attractive visual elements of the landscape. Water has important effects on landforms through sedimentation and erosion, and on the types, quantities and distributions of vegetation, aquatic organisms, and wildlife. In arid landscapes especially, there are a wide range of cultural, spiritual, and religious values related to water. Changes in water regimes and the associated changes in landforms, vegetation and wildlife can have significant effects on many different types of human perceptions and values. Current policies for water management emphasize technical standards and legal regulations that address only a few of the relevant human values, primarily those involving consumptive uses. This paper departs from traditional views of reclamation by highlighting the highly variable and contingent ways in which new science-based forms of water management were proposed and negotiated in specific local places with particular cultural, legal, and historical geographies. Drawing theoretically from literature on the ‘geography of science,’ the paper probes the ways in which authority for a scientific approach to water management was created, negotiated, and expressed in local and regional contexts in the Territory of New Mexico, where authoritative systems of practical resource use and administration had been in long use before the U.S. government initiated its federal water reclamation program in 1902. Specifically, the paper examines two disputes entered and argued in front of northern New Mexico’s Rio Arriba District Dourt between 1903 and 1905.
