Claims Analysis was found to be more difficult than expected to learn, to communicate to systems developers, and to apply effectively in practice. The work has highlighted a tension between user-centered and function-oriented design approaches and differences in values and perspectives between the human factors specialists and traditional Findings - It is possible to estimate the degree of risk involved in offering digital library services, in such a way as to manage this risk in a practical and responsible manner. Research limitations/implications - Further experience of digital rights issues will better inform discussion of these matters as digital library services grow and mature in the near future; immediate examples of digital library practice in this regard are minimal and remain uncertain in their interpretation as yet. Practical implications - The principles outlined may offer practitioners some useful insights into how to manage copyright aspects of their digital library collections on a day to day practical level. Originality/value - This paper attempts to offer some clear principles to help practitioners grasp an area that has appeared new and intimidatingly uncertain to date. Copyright is a particularly complex area for librarians who work with media. Frequently, librarians are confused about the legality of certain uses of media. This confusion is magnified when vendors sell licenses to librarians when they are not necessary. The Technology, Education and Copyright Harmonization Act of 2002 is a convoluted law that many view as a restriction of fair use rights. Fair use is a copyright exception that can be applied to all of the exclusive rights of copyright including public performances and digital transmissions.
