Defendant killed de facto, who had been abusive for several years prior. The defendant moved out of the family home and got a DVO, but the victim ignored it. The defendant agreed to let him have contact with the children, and when she rejected him having them overnight he violently abused her once again. He stopped, sat on the bed with his back to her, at which time she got a knife and stabbed him.
