governance framework of the EU, and of the euro area in particular.\nThe fiscal rules (laid down in the Stability and Growth Pact) have been weakened over time, and procedures and measures put in place to enforce economic policy coordination have not been implemented. The European Council of 24-25 March 2011 adopted a comprehensive package of measures to respond to the ongoing crisis, as well as to guard against such crises materialising in the future. The main features of this package relate to the strengthening of the preventive and corrective mechanisms to address internal and external imbalances, in particular fi scal imbalances and competitiveness problems of individual Member States, well before they might pose systemic threats. In addition, the package includes the establishment of a permanent crisis management mechanism as an ultima ratio safeguard against imbalances in individual countries. It is foreseen that the new European Stability Mechanism (ESM) will enter into force on 1 July 2013, following\nan amendment to the Treaty on the Functioning of the European Union (the Treaty) and the signing of an ESM Treaty by the euro area countries. Both responses have contributed to substantially redesign the architecture of the economic and monetary union. This article focuses on the mechanisms of assistance - most of which have been agreed intergovernmentally outside the EU Treaties -, describing them and examining their most significant legal implications. These are their compatibility with the no bail-out clause, the limited revision of the Treaties to include new Article 136(3) TFEU, the use of Article 122(2) TFEU as the only legal basis under the Treaties to provide financial assistance, the relationship between the intergovernmental mechanisms of assistance and the law of the Union and the judgment of 7 September 2011 of the German Constitutional Court on the compatibility of mechanisms of assistance with the German Constitution. Il faut attendre le mois de mai 2010 pour qu’un ensemble de mesures soient arrêtées. Ont ainsi vu le jour les mécanismes européens de stabilité. Initialement, ces mécanismes comprenaient l’aide spécifique prévue pour la Grèce, le mécanisme européen de stabilisation financière (MESF) et le fonds européen de stabilité financière (FESF). Une révision de l’article 136 du TFUE a finalement consacré en droit primaire le Mécanisme européen de stabilité (MES) qui a vocation à remplacer le MESF et le FESF. Cependant, l’article 136, paragraphe 3, du TFUE prévoit uniquement que les Etats membres de la zone euro peuvent établir le MES. Celui-ci a été institué sous la forme d’une institution financière internationale par un traité signé le 2 février 2012, par les Etats membres de la zone euro.
